Dear Sir,
Thank you for you enquiry. In response to your query, we would like to
inform you as under.
1) For filing one trade mark application in one particular class
of goods / services (limited items), you are required to send us
filled in up instruction form and the Power of Attorney duly signed by
the applicant.
2) The fees and charges for filing one trade mark application is
Rs. 18,000/-, which includes Govt. fees, our fees, Incidental expenses
and Service Tax.
3) Normally 24-30 months of time are taken from the date of filing
of application, to get the trade mark registration certificate. The
right to the mark is counted from the date of filing of the
application, and the date of registration is the date of application,
although the certificate will be issued after approx two years.
4) Usually, during the course of 2 years time, approximately Rs.
9,000/- is to be borne, in two different stages, i.e. for taking steps
for advertisement in the Trade Marks Journal, and for taking steps
registration. In case there is objection, opposition from any quarter,
there will be additional expenses, which cannot be foreseen, and
depends on the circumstances.
5) Once the matter is entrusted to us, we shall act in the
interest of our client and shall provide our legal service, by making
suitable advices.
6) For filing one copyright application for the artistic work
(Label), you are required to send us at least 20 printed labels of
same nature and Rs. 20,000/- for preparing and filing the search
application, copyright application and other related documents. Once
the copyright is registered, it is valid for life of the author/artist
and 60 years thereafter, and there is no renewal.
